DAÖMEY - General Terms and Conditions of Sale
Preamble
Welcome to the website www.daomey.com (hereinafter referred to as the "Website")! These general terms and conditions of sale (hereinafter referred to as "GTC") exclusively govern the sales of products offered on the DAÖMEY online store. The customer can access the GTC at any time on the Website. The customer is obliged to adhere to the GTC at the time of order, to the exclusion of all other conditions present in catalogs, stores, or brochures. The merchant website www.daomey.com is published by SARL DAOSCORP 2 rue André Bru 94800 Villejuif.
Article 1. Purpose
These general conditions govern the sale of DAÖMEY items presented on the Website " www.daomey.com " by the company DAOSCORP, hereinafter referred to as "Daoscorp", a limited liability company with a capital of €345,000.00 located at 2 rue André Bru 94800 Villejuif registered under number 820 437 390 in the Paris trade and companies register, to all non-professional and adult natural persons hereinafter referred to as the "Client".
Article 2. Customer Account
Any new customer must create a customer account either at the time of ordering or beforehand in the "My account" section. The Client must register with a valid email address and choose a password that they will use for each connection to the Website and for each purchase made.
After providing this information, the Client must fill out a form specifying their last name, first name, year of birth, postal address of residence, phone number, and email address. The Client can, if desired, deactivate their account at any time by clicking on the "Contact us" section.
Article 3. Order
To place an order, the Client can browse the online catalog and click on "Add to cart" to select the Product(s) of their choice. The Client is invited to choose the size, color, and desired quantity. It is possible to access the cart at any time to view or remove one or more selected Products.
The Client can then click on "Return shopping" to access the catalog again or "Continue" to finalize the transaction.
A summary page - which corresponds to the order form - then appears, showing information related to the Client and the order: billing address, delivery address (if different from the billing address); nature, price, and quantity of the Products, as well as the amount of
participation in delivery costs.
The Client can then click on "Return" if they want to change their choices or "Payment" to accept their choice and validate their Customer Account data as well as the delivery and billing address. At the end of the order, a confirmation email will be sent to the email address the Client provided in their Customer Account, reminding them of their order details (Products, Price...). It will be recommended to the Client to keep this email as proof of purchase until receipt of the package with the invoice.
Article 4. Price
The prices of the Products are indicated in euros, all taxes included (VAT applicable on the date of the order), excluding delivery costs.
DAOSCORP reserves the right to modify the prices of the Products at any time. The applicable prices are those in effect on the Website at the time of order validation.
Article 5. Products
The Products offered for sale are those that appear on the website www.daomey.com on the day of consultation of the Website. The offer for sale of Products is valid within the limits of available stock. The photographs illustrating the Products are intended to be as accurate a reproduction as possible but are not contractual. The Client can consult the description of each Product to find out its main characteristics.
Article 6. Delivery
Deliveries are made by Colissimo. The customer will receive an email from La Poste confirming the dispatch of their order, as well as the delivery number allowing them to track their order via the website www.colissimo.fr. If La Poste services are unable to deliver the package, the postman will leave a delivery notice in the customer's mailbox indicating, among other things, the post office where the package will be deposited. Delivery times are 7 to 9 working days after payment validation of the order.
This period may, however, be extended at certain times (private sales, promotions, etc.) but does not exceed 8 days. Subject to normal delivery times by La Poste. Contribution to delivery costs: The customer's contribution to delivery costs depends on the destination of the order and its amount.
Article 7. Right of withdrawal
The Client has 7 clear days from the day of receipt of the order to exercise their right of withdrawal. The return shipping costs are borne by the Client. To exercise this right, the Client must contact DAOSCORP by email at the contact address mentioned on the Website.
Article 8. Payment
Payment is made in full at the end of the order. Payment is made online by credit card. Or via the customer's Paypal account. In case of payment default, wrong address or any other problem related to payment, DAOSCORP reserves the right to block the Client's order until the problem is resolved.
Article 10. Returns and exchanges
The Client has a period of 8 days from the date of receipt of the order to return Products that do not suit them. Items must be in perfect condition (new, clean, and complete) and in their original packaging. Return costs are the responsibility of the customer. To be reimbursed, the Client must return the item(s) in the package, accompanied by the return number provided by DAÖMEY, to the following address:

Article 11. Liabilities and legal guarantees
The Products offered on the Website comply with current French legislation. The photographs illustrating the Products are provided for illustrative purposes and are not contractual. The Client is invited to consult the detailed description of each Product in the
catalog. In case of an error in any of the photographs, texts, etc., DAOSCORP cannot be held responsible. In case of any doubts or questions, the Client is invited to contact DAOSCORP via the "Contact us" tab. In case of stock shortage or unavailability of the Product, strike by means of transport, or in case of force majeure, DAOSCORP cannot be held responsible. According to articles L.211-4 to L.211-14 of the Consumer Code and 1641 to 1648 of the Civil Code, DAOSCORP is obliged to deliver the Products in accordance with the contract and must be responsible for defects of conformity as well as hidden defects that may be found after delivery. In case of a defect of conformity, the Client is invited to return the Product for a refund. In case of hidden defects, DAOSCORP undertakes to refund the Product concerned, provided that the defect is reported by the Client within 7 days from the delivery date.
Article 12. Intellectual property and personal data protection
The use of the Website and its services is strictly for personal use. In accordance with the laws governing intellectual property and the ownership of artistic and literary rights, the texts, illustrations, images, photographs, designs, logos, comments... present on the website www.daomey.com are the exclusive property of DAOSCORP or its suppliers, and any total or partial reproduction is strictly prohibited. Furthermore, DAOSCORP undertakes to respect the confidentiality of the personal data of Clients that they have provided in their Customer Account or at any time during the order.
Article 13. Retention of title
DAOSCORP retains exclusive ownership of the delivered items until full payment of their price.
Article 14. Disputes
In the event of a dispute that cannot be resolved amicably, the Commercial Court of Paris shall have sole jurisdiction, regardless of the terms of sale and the method of payment, which is expressly accepted by the customer. The products and obligations of the parties are exclusively governed by French law.
These General Terms and Conditions of Sale are applicable from May 23, 2016.
